End-User License Agreement The following is a licensing agreement between the purchasing party (end-user) and Ascad Networks. These terms apply to any software produced by Ascad Networks and sold on the Ascad Networks website (http://www.ascadnetworks.com/). In purchasing any software from Ascad Networks, you agree to be bound by the following terms and conditions. 1. Free Installation of Software
Ascad Networks generally completes installations within 24-48 hours following a purchase. This timeframe may be extended at the discretion of Ascad Networks. B. In the event that problems arise during installation, Ascad Networks will take the following steps: a. Contact the end-user's web hosting provider in an attempt to solve the issue. C. In the event that it is determined by Ascad Networks during installation that our software and the end-user's web server are incompatible, the end-user will have the following options:
B. Ownership: Any software purchased from Ascad Networks remains the sole property of Ascad Networks.
a. The software will only be installed on a single website domain.
c. The Ascad Networks logo, located at the bottom of the software's control panel, must remain unchanged and intact.
A. Transferability of Licenses: Licenses are granted to the purchasing end-user only and cannot be sold or transferred to other persons. B. Resale of Software: It is strictly forbidden to resell the software in any shape or form. C. Distribution of Software: If is strictly forbidden to distribute the purchased software in any shape of form.
B. Ascad Networks cannot guarantee that the purchase software is free of bugs. In the event that a bug is reported, Ascad Networks attempts to resolve the issue within a reasonable timeframe. a. Software Updates: Ascad Networks periodically issues updates to all of its software. It is the end-user's responsibility to download and install these updates. Updates improve software performance and remove bugs.
In order to be eligible for the 30-day money back guarantee, users must either:
Failure to do either of the above listed actions will results in a forfeit of the 30-day money back guarantee. A. Custom Programming: In the event that the end-user purchased custom programming on any purchased software and then requests a refund, the manual labor fee associated with the custom programming will not be refunded. B. Verification of End-User's Claim: Ascad Networks reserves the right to verify the end-user's refund request in the event that the issue is related to server-incompatibility. Before a refund is issued, Ascad Networks requires that the end-user provide full FTP access. Ascad Networks will attempt to solve the issue. If the claim of server-incompatibility is confirmed, meaning that Ascad Networks cannot make the software function on the end-user's server, a full refund will be issued. C. Refund without Professional Installation: For software, no refunds will be issued unless Ascad Networks has performs the installation of the software. Opting out of your free installation by not providing FTP Login information at the time of purchase is a forfeit of your 30-day money back guarantee. D. Refunds After 30 Days: No refunds will be issued after 30 days, regardless of whether they meet the above listed specifications. E. Removal of Software: Before a refund is issued, the end-user must remove all copies of the software from both local computers and web servers. In the event that the program is used following a refund being issued, your credit card will be charged without notice for the price of the product. F. Requesting a Refund: All refunds MUST be requested by phone. To request a refund, call (630) 214-9598 anytime from 10AM to 5PM (Central). Please have your order number ready.
